Terms
Payment & Image Delivery Time Payment in full is required prior to the release or delivery of any photographic materials, unless other arrangements have been expressly agreed upon. Standard delivery time for photographic galleries is one (1) business day following the shoot date, and video deliverables will be provided within forty-eight (48) hours, unless otherwise discussed and mutually agreed upon in advance.
Travel Fee A travel fee shall apply to any property located more than thirty (30) miles from ZIP code 23462.
Photo Licensing Agreement Suzanna Stern Photography, LLC/Suzanna West (PHOTOGRAPHER) retains the copyright for all digital images created in the course of doing business and all images on this website. The commissioning real estate broker/agent (CLIENT) is granted a license to use property images, for which they have paid, for the promotion of that property in any media while CLIENT manages the listing. License expires once property has Sold, Expired or is Withdrawn. Images must not be edited/altered by anyone other than PHOTOGRAPHER with the exception of minor cropping and/or resizing only.
CLIENT may NOT give, license or sell images to anyone. This includes the property owner, other broker/agent/Realtors, builder, architect, stager or any other vendor. Disregarding these terms will result in copyright infringement/violation ( Digital Millennium Copyright Act of 1998, 17 U.S.C. �????????�???????�??????�?????�????�???�??�?�§512(c) ) and may result in legal action. PHOTOGRAPHER recognizes that CLIENT does not control how images are shared by REIN MLS and syndicated to other property listing sites (Zillow, Trulia, et al.) and CLIENT is not liable for such use beyond license expiration.
PHOTOGRAPHER may re-license real estate images for commercial use by developers, builders, designers, vendors, or other parties. This will be executed with a separate agreement between PHOTOGRAPHER and licensee.
Drone Flight Restrictions All aerial operations shall be conducted in compliance with all applicable Federal Aviation Administration (FAA) rules and regulations. The Photographer makes no guarantee that drone flight authorization will be granted in all geographic locations, as certain areas may be restricted or prohibited under FAA or local ordinances. In the event drone flight cannot be performed due to such restrictions, no liability shall be incurred by the Photographer. Photographer reserves the right to postpone or cancel aerial operations due to unsafe weather.
Cancelation Policy Cancellations made less than twenty-four (24) hours prior to the scheduled appointment time shall incur a cancellation fee of one hundred dollars ($100.00). This fee is due immediately upon cancellation. The Photographer reserves the right to waive or modify this fee at their sole discretion.
Image Archiving Final images are securely backed up by Photographer and are available to re-deliver 90 days from date of delivery. After that time, files may no longer be available. Clients are encouraged to create a local backup for use during the active property listing. When the client's agreement with the homeowner ends (when the property is sold or picked up by another agent), the image license automatically expires and copies of images must be deleted.
Property Readiness and Safety Client shall ensure that the property is clean, presentable, and in a condition suitable for photography at the time of service. Photographer shall not be responsible for cleaning, decluttering, moving furniture, or performing any preparatory tasks beyond minor adjustments (such as opening blinds or turning lights on/off). Client is responsible for ensuring that all pets are safely confined and kept out of view during the session.
Limitation of Liability Photographer's liability for any claim arising from services rendered shall be limited to the total amount paid by the Client. Photographer shall not be liable for consequential or incidental damages.
